1. Scope
For business relations between us ("Pappzarapp") and you, the following General Business Relationships shall apply exclusively in the version valid at the time of the order. The Online Shop is available in German and English, the contractual language is German.

2. Contract partner
Your contract partner is Pappzarapp Ojala & Dürmeyer Print Media GbR, ℅ SPACE M, Motzstraße 5 in 10777 Berlin, Germany.

3. Order and conclusion of contract
During the ordering process, Pappzarapp provides a configurator which you can use to design your individual cardboard book.

You can put your designed cardboard book into the shopping cart without obligation at first and correct your entries at any time by using the functions provided for this purpose. By clicking on the "Pay now" order button, you place a binding order for the goods contained in the shopping basket.

After placing your order you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment order to PayPal. Thereby the contract with us is concluded.

You will then receive an order confirmation from us at the e-mail address provided.

4. Prices
The delivery of the goods will be made at the prices in euros as indicated in the Pappzarapp App, valid on the day of the order. The price is made up of the order value, shipping costs and other price components and includes the applicable statutory VAT. Additional customs duties may apply for shipments to countries outside the European Union. These are not included in the price and may have to be paid by you.

5. Terms of payment
The purchase price is due for payment after conclusion of the contract. Payments shall be deemed to have been made on the day on which Pappzarapp can dispose of the amount.

Within the framework of the payment service PayPal Plus we offer you various payment methods as PayPal Services. You will be forwarded to the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the payment method PayPal, you must be registered there or register first to be able to pay the invoice amount and legitimise yourself with your access data. The payment transaction is automatically carried out by PayPal immediately after confirmation of the payment order. You will receive further instructions during the ordering process.

If you have chosen the credit card payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment order and after your legitimation as the rightful cardholder by your credit card company at the request of PayPal and your card will be charged. You will receive further instructions during the ordering process.

If you have chosen the payment method direct debit, you do not need to be registered with PayPal to pay the invoice amount. With confirmation of the payment order you give PayPal a direct debit mandate. PayPal will inform you about the date of the debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is executed and your account is debited. You will receive further instructions during the ordering process.

6. Terms of delivery
Delivery is only possible within the EU and to Switzerland. Delivery dates are only binding if they are expressly designated as such by pappzarapp. Slight exceeding of agreed delivery dates does not constitute a right of withdrawal or a claim for damages.

In the event of force majeure and all obstacles for which pappzarapp is not responsible and which have a significant influence on the delivery, the delivery time will be extended accordingly.

7. Retention of title
The goods ordered remain the property of pappzarapp until full payment has been received.

8. Right of withdrawal
A legal right of revocation for consumers does not exist according to § 312 g para. 2 no. 1 BGB (German Civil Code), as we provide our services exclusively according to individual selection and determination.

9. Warranty
Pappzarapp is liable for material defects in accordance with the applicable statutory provisions.

We would like to point out that when using the editor function (enlargement of the image section), the app no longer checks the dot density (dpi). Please also note that a crop margin of at least 4 mm is required for the production of the book, which minimally reduces the image area.

Due to the robust, handmade book binding, it can happen in rare cases that the cardboard book does not close completely after opening for the first time, but opens slightly.

10. Copyright
You alone are responsible for the legality of the content and the transmission of the image files. In particular, you must ensure that you own the necessary copyrights, trademark rights or other rights for all image files transferred to pappzarapp, as well as for the use commissioned, and that you have the necessary permissions from the persons depicted.

All consequences arising from a violation of these rights are solely your responsibility. You are obliged to indemnify pappzarapp against all claims by third parties which they may assert due to the infringement of their rights resulting from the processing, reproduction and use of the transmitted image files.

11. Granting of licences
In principle, you retain all rights to all image files you submit to pappzarapp. In order to execute the contract, you transfer to pappzarapp the spatially unlimited right to use the transmitted image data for the services to be provided in the context of the execution of the contract. This includes the storage, duplication and processing of the image data.

12. Electronic invoice
You agree to an invoice transmitted by electronic means.

13. Liability
Pappzarapp shall be liable for intent and gross negligence in accordance with statutory provisions. In the event of damage to property and financial loss, pappzarapp's liability is limited to typically foreseeable damage only in the event of breach of material contractual obligations.

14. Information on Online Dispute Resolution

We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

15. Place of performance, place of jurisdiction and applicable law
For merchants, legal entities under public law and special funds under public law, the place of performance is the location of our registered office. The place of jurisdiction in this case is Berlin.

German law shall apply to the exclusion of the UN Sales Convention.
